Agreement to Terms
By accessing or using the Empatalk platform at empatalk.app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Empatalk.
Description of Service
Empatalk is an AI-powered communication platform that helps individuals and teams understand and bridge different communication styles. The Service includes:
• Communication DNA Survey: a multi-step assessment that maps your unique communication preferences
• AI-generated Guidelines: personalized "How to work with me" guides based on your survey responses
• Profile Comparisons: AI-powered compatibility analysis between two users
• Team Compatibility Dashboard: organisation-wide communication insights for managers
• Mediated Conversations: real-time AI assistance during workplace messaging
• Slack Bot Integration: Empatalk features directly in your Slack workspace
Account Registration
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality and security of your account credentials
• You must be at least 16 years old to use Empatalk
• One person may not maintain more than one active account
• You must notify us immediately if you suspect unauthorized access to your account
Acceptable Use
You agree to use Empatalk only for lawful purposes and in compliance with these Terms. You may not:
• Attempt to reverse-engineer, decompile, disassemble, or hack any part of the platform
• Use the AI features to generate harmful, discriminatory, defamatory, or misleading content
• Share your account credentials with others or allow others to access your account
• Scrape, crawl, or use automated tools to collect data from the platform
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to build a competing product or service
• Upload content that infringes the intellectual property rights of others
Subscription Plans and Payment
• Free: includes the Communication DNA survey, AI-generated guidelines, public profile page, basic Slack bot commands, and support for 6 languages
• Pro: includes everything in Free plus profile comparisons, synergy and tension analysis, priority AI processing, and advanced profile visibility controls
• Team: includes everything in Pro plus the team compatibility dashboard, organisation member management, team-wide risk alerts, per-member compatibility scores, and team Slack bot commands
• Enterprise: includes everything in Team plus custom integrations, API access, dedicated support, custom AI model tuning, SSO, and advanced security. Contact us for pricing.
• Prices are displayed in your local currency and are subject to change with 30 days written notice
• Paid subscriptions are billed monthly or annually through Stripe. Annual billing includes a 20% discount.
• Refunds are available within 14 days of initial purchase or plan upgrade
Intellectual Property
• The Empatalk platform, including its source code, design, branding, and documentation, is owned by Empatalk and protected by copyright, trademark, and other intellectual property laws
• Your survey answers, profile data, and personal content remain your property
• AI-generated guidelines, comparisons, and suggestions are licensed to you for personal or internal team use and may not be resold or redistributed
• The Empatalk name, logo, and related marks are trademarks of Empatalk
AI-Generated Content Disclaimer
Empatalk uses artificial intelligence to generate communication guidelines, compatibility analyses, and conversation suggestions. This content is:
• Advisory only and should not be treated as professional psychological, medical, or legal advice
• Generated based on self-reported survey data and may not fully reflect your communication style
• Subject to the limitations and biases inherent in AI language models
• Not a substitute for direct human communication, professional mediation, or therapy
Limitation of Liability
• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim
• Nothing in these Terms excludes liability that cannot be excluded under applicable law
Indemnification
You agree to indemnify and hold Empatalk harmless from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the Service.
Termination
• You may delete your account at any time from your Account settings page
• We may suspend or terminate accounts that violate these Terms, with notice where practicable
• Upon account deletion, your personal data will be permanently removed within 30 days in accordance with our Privacy Policy
• Provisions that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will survive
Modifications to Terms
We may modify these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Governing Law and Disputes
These Terms are governed by the laws of the European Union and the applicable member state where Empatalk is established. Any disputes arising from these Terms will be resolved through the courts of the applicable jurisdiction. For EU consumers, mandatory consumer protection laws of your country of residence apply.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
